In the court below two indictments were returned lagainst William Straussi, appellant herejin, Samuel Strauss, his brother, and Stewart Mathias, an employee of William Strauss, appellants in Nos. 28 and 29 October Term, 1926, of this court, in the first of which they were charged with setting fire to the dwelling house of the said William Strauss, with intent to burn the same and with intent to defraud certain insurance companies; and in the second, with conspiring and agreeing to cheat and defraud said insurance companies by setting fire to and burning said dwelling…
