Appellants Nussie Eosen and Leon Fitterman and seven others were jointly indicted, charged with conspiracy to set up and maintain a gambling house and to engage in pool selling and book-making. Four of the defendants were fugitives and had not been apprehended. Defendant Meyer Fitterman pleaded guilty; appellants with defendants Larry Katz and Joseph Saracino were jointly tried; all four were convicted.
