WALKER, Chief Justice.
This appeal was prosecuted from the district court of Harris county to the Galveston Court of Civil Appeals, and transferred to this court by orders of the Supreme Court.
On the 28th day of February, 1928, W. R. Fulton executed a certain promissory note to appellee, H. A. Goodwin, in the principal sum of $2,100, payable in monthly installments of $25 each, the first installment due ninety days after date. W. R.
