THIS CAUSE comes before the Court upon Defendant Sovereign Bank’s (“Sovereign”) Motion to Dismiss (the “Motion”) (DE #2148), filed November 21, 2011. *1292Therein, Defendant seeks to dismiss Plaintiffs First Consolidated Amended Class Action Complaint (“CAC”) (DE #2027) pursuant to Federal Rule of Civil Procedure 12(b)(6) on the grounds that Plaintiffs claims are preempted and fail under Maryland law.
