This is an action for trade name infringe ment and unfair competition brought in Kitsap County Superior Court by plaintiff, Tradewell Stores, Inc., against defendant, T. B. & M., Inc. The trial court’s unchallenged finding was that plaintiff had appropriated a trade name, “Family Market,” to denominate a discount food store operation in Shelton, (Mason County) Washington, and that defendant’s later use of the name, “Family Mark-It,” to describe a similar discount food store in Bremerton, (Kit-sap County) Washington was an infringement.
