The above action has been submitted on pleadings and proofs. From the pleadings and proofs the court finds the following facts:

- (1) The complainant, Jane E. Waldron, in February, 1889, by the selection of a building site located and, in July of the same year, went upon the land in controversy to reside; said land being described as follows: The S.
