There was but one witness in this case on the part of the government, who testified that, about a month before the finding of the indictment, defendant came to his place of business in an intoxicated condition, and pulled out his sixshooter, and said, “Let’s go shoot ’em up.” He afterwards put his six-shooter “back in his clothes,” and walked away in a northwesterly direction, after which witness heard shooting in the direction in which defendant had gone.
