OPINION
SWEET, District Judge.
Defendants Drs. Bendheim, Bernstein, Koenigsmann, and Wright and Physician Assistant Rodas (collectively, the “Defendants”) have moved under Rule 12(b) 6, F.R. Civ. P. to dismiss the amended complaint of plaintiff, pro se, Ronald Alston (“Alston” or the “Plaintiff’) alleging violations of 42 U.S.C. § 1988. Upon the conclusions set forth below, the motion is granted and the amended complaint is dismissed.
