Order unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Plaintiff was engaged in the erection of forms to be used in the construction of reinforced concrete columns. The forms were arranged at ground level and were anchored to the ground. Estimates of the height of the forms varied from 12 to 20 feet. While walking at ground level, plaintiff was injured when one of the forms collapsed and fell on him. Supreme Court granted plaintiffs motion for partial summary judgment on liability pursuant to Labor Law § 240 (1). That was…
