The facts controlling on this appeal are not disputed. The appellee, Elinore Mapes Pierce, by deed of trust executed March 7,, 1935, transferred and delivered to her husband, Earle V. Pierce, as trustee, 6,000 voting trust certificates of the Cream of Wheat Corporation, with directions to pay and apply the net income of the trust' estate solely and exclusively to and for religious, charitable, and educational purposes, with the intention on the part of the settlor, expressly declared in the trust instrument, of creating a public charity trust, as authorized by Chapter…
