Upon indictments for first degree murder, a Superior Court jury found the defendants, Robert Wojcik (Robert) and his uncle Stephen D. Wojcik (Stephen), guilty of murder in the second degree. G. L. c. 265, § l.2 The Commonwealth’s evidence tended to show that on June 3, 1993, the defendants, who were passengers in a rental truck being driven by one Marc-Anthony Usher, engineered a motor vehicle collision in Springfield for purposes of insurance fraud, causing the death of Paul Langevin.
