Plaintiff Marvin Pulvers appeals from a judgment, entered July 8, 1999, affirming the denial of his application for disability insurance benefits under a group policy (the “Policy”) issued by defendant First UNUM Life Insurance Company (“UNUM”) to Pulvers’s law firm. UNUM denied the application for benefits on the ground that Pulvers’s disability was a preexisting condition and, thus, was not covered by the Policy. We conclude that this determination, although nominally based on an unreasonable construction of the Policy (as we discuss below), was not arbitrary…
