WOODBURY, Circuit Judge.

The appellant, Mercado Gomez, pleaded guilty in the court below to both counts of an indictment charging him, respectively, with the transportation of a revolver, and with the transportation of revolver ammunition for the same, and thereupon he was sentenced to two years on each count, the sentences to run consecutively. These events occurred on March 25, 1949. Subsequently, on December 21, 1949, while serving the sentence imposed on the first count, he filed a. verified motion for correction of sentence under 28 U.S.C.A. § 2255 in which he asked that the sentence on…
