This appeal arises from a suit instituted by the plaintiffs against the defendants in which plaintiffs sought to have determined the nature of the title acquired by the defendants in a prior condemnation proceeding to a certain tract of land that had been owned by the plaintiffs. In Count I of plaintiffs’ amended complaint the court was requested to declare plaintiffs the fee simple owners of the subject property free of any right, title and interest in the defendants.
