McGRANERY, District Judge.

The defendant in this case has been indicted and charged with failure to be inducted into the Armed Forces in violation of the Selective Training and Service Act of 1940, 50 U.S.C.A. Appendix, § 311. The trial was held in this Court on January 30, 1947, without a jury, under Rule 23 of the Federal Rules of Criminal Procedure, 18 U.S.C.A. following section 687. Neither party has requested special findings of fact in accordance with that rule, but they shall be incorporated into this opinion, in order to make clear the basis of the general finding.
