Plaintiff, while he was incarcerated in the federal penitentiary in Terre Haute, Indiana, brought a pro se civil rights action against defendant Jerry Pitts, pursuant to 42 U.S.C. § 1983.1 The events which allegedly gave rise to plaintiff’s cause of action occurred in Chattanooga, Tennessee, and plaintiff properly commenced his action in the United States District Court for the Eastern District of Tennessee.2 When plaintiff did not appear at two preliminary hearings because of his custody in a federal penitentiary, the district court dismissed his action for…
