In a matrimonial action for a divorce and to recover a money judgment for necessaries and the alleged conversion of personal property, the defendant appeals from an order of the Supreme Court, Queens County (Durante, J.), dated August 7, 1981, which denied his motion to vacate a judgment of the same court dated April 20, 1981, entered against him upon his default in appearing and answering, and for leave to serve an answer. Order reversed, with $50 costs and disbursements, motion granted, and judgment dated April 20, 1981 vacated. Defendant’s time to serve his answer is extended until 10 days…
