IVERS, Judge:
Marion C.H. Lematta, through counsel, has filed an application for attorney fees under the Equal Access to Justice Act (EAJA). 28 U.S.C. § 2412(d); see also U.S.VetApp.R. 39(b). For the reasons set forth below, we deny the appellant’s application.
I. FACTUAL BACKGROUND
On June 4, 1993, the Board of Veterans’ Appeals (BVA or Board) denied the appellant’s claim for entitlement to service connection for bilateral talar (ankle joint) disorder and intermittent hematuria (condition of *506blood in the urine) (Stedman’s Medical Dictionary 1761 772, (26th ed. 1995)).
