A criminal complaint was issued in the Lowell Division of the District Court Department against the defendant charging him with possession of a class B substance with intent to distribute in violation of G. L. c. 94C, § 32A (a), and with possession of a class B substance with intent to distribute within 1,000 feet of a school zone in violation of G. L. c. 94C, § 32J. The defendant’s pretrial motion to suppress was accompanied by a sworn affidavit. After a three-day trial, the defendant was convicted of both charges by a jury of six.
