OPINION
VOLINN, Bankruptcy Judge.
The Chapter 7 trustee sought to avoid certain payments made to Smythe Buick, Inc. dba “Smythe Buick Isuzu.” The trustee and Smythe each moved for summary judgment. Trustee appeals from summary judgment in favor of defendant Smythe. We affirm.
At the outset, we recognize that the burden is on the moving party in a summary judgment motion, to establish that there are no genuine issues of material fact thereby warranting a disposition of the case on the basis of applicable legal principles.
