People v. Walters

1Per curiam
Believing that someone at the Veterans Administration hospital in western Los An-geles had disposed of hazardous medical waste in violation of California law, the city attorney initiated a criminal prosecution in municipal court against the Veterans Administration and Walters, its administrator.
The complaint was removed to district court pursuant to 28 U.S.C. § 1442(a). The district court dismissed the complaint on the grounds that the defendants were protected by sovereign immunity and that their immunity had not been clearly and unambiguously waived. The city attorney appeals and we affirm.
