Bill ih equity in the nature of a bill of interpleader, by the trustees under the will of Henry Farnum, to obtain the instructions of the court as to the, validity of a charitable bequest in the will, and as to a matter arising out of their administration of the trust. The case was heard on the bill and answers by Colt, J., and reserved for the determination of the full court. The facts appear in the opinion.

The will of Henry Farnum, a resident of this Commonwealth, directs that the income of a certain fund accumulated under its provisions “ shall be paid annually by the trustees, acting under the will, to such person or persons as shall, from time to time, be appointed by the judge of probate for the time being in the district of Norwich in the state of Connecticut, to take, receive and distribute the same among the poor meritorious widows, living and belonging within the limits of the First Ecclesiastical Society of the town of Norwich and district aforesaid.” It further provides that, if from…
