The plaintiff in error, hereinafter called defendant, was convicted in the district court of Logan county of manslaughter in the first degree and was sentenced to serve a term of 12 years in the state penitentiary.

Defendant was charged with the murder' of one Willie House in the city of Guthrie. The testimony for-the state discloses a state of facts about as follows: Deceased, a negro youth, and four other negro boys were sit ting on a projection of a building at a street corner as defendant and one Richardson were passing.
