CAMMACK, Justice.

This is an appeal from a judgment of the Carter Circuit Court sustaining an award of the Workmen’s Compensation Board in fav- or of John Johnson. The claim was filed against Charles Sexton and was later amended to make L. Y. Suttles a party defendant. The Bituminous Casualty Corporation, Sexton’s liability insurance carrier, intervened. The award and judgment ran against Sexton, Suttles and Bituminous. Bituminous has appealed and Johnson has filed a cross-appeal.
