Valley Baptist Medical Center (“VBMC”), appellant, brings an interlocutory appeal from the tidal court’s denial of its motion to dismiss the underlying cause of action. Tex. Civ. Prac. & Rem.Code Ann. § 51.014(a)(9) (Vernon Supp.2006). Margaret Stradley, appellee, has filed a motion asking this Court to dismiss the appeal for lack of jurisdiction.
