Appellee sued appellant in the district court of Grayson county for damages for personal injuries, and secured a verdict and judgment, from which appellant has appealed. Appellee was a ear repairer in the employ of appellant, and at the time he received his injuries he was engaged with other employés in attaching a pair of inside wheels to a car loaded with coal. In order to place the wheels upon the ear, it was alternately raised and lowered with jacks, and while being lowered the jack collapsed, and appellee was seriously and permanently injured.
