The bill and answer in this case have been so fully set forth in the decision, which has hitherto been given by the Court on a demurrer to the bill, that I regard it unnecessary to present them in full ag’ain, and will only refer to them in discussing the positions taken by the parties.

The execution of the agreement of the 11th of January, 1821, by and between Kalaimoku and the respondent, which is set forth in the bill, is admitted ; and further, that the respondent, in pursuance of said agreement, entered into possession of the premises as tenant in common with Kalaimoku, and has continued…
