I. INTRODUCTION

This cause is before the court on a Partial Motion to Dismiss Amended Complaint *1228(Doc. # 29), filed by the Defendant, Autozoners, LLC.

The Plaintiff, Tommy Ambus, filed a Complaint in this ease on November 2, 2012. On January 29, 2013, the Plaintiff filed an Amended Complaint which includes the following under “Causes of Action”: “A. Race Discrimination in Violation of 42 U.S.C.
