This is an action of tort for personal injuries suffered by the plaintiff while attempting to board a car of the defendant. At the trial in the Superior Court* he recovered a verdict, and the case is here on the defendant’s exceptions.
*421The evidence as to the plaintiff’s position at the time of the accident is irreconcilable.
