MEMORANDUM AND ORDER ON PLAINTIFF’S MOTION FOR SUMMARY JUDGMENT
SKINNER, District Judge.
The plaintiff, Aetna Casualty & Surety Company (“Aetna”), brings this declaratory judgment action based on diversity of citizenship seeking a determination of its non-liability to defendant, Edward M. Clasby (“Clasby”), under a pension and welfare fiduciary responsibility insurance policy.
