Wayne Wirsing, sheriff of Price County at the commencement of this action, appeals from a judgment of the circuit court. The court ordered Wirsing to reinstate Richard Heitkemper as a deputy sheriff of Price County (County) in accordance with the collective bargaining agreement between the County and the deputies' union. Wirsing contends that the collective bargaining agreement usurps his constitutional and statutory authority to appoint a deputy.
