November 1st, 1881, the decedent, who was:then a widow bearing the name of Olive L. Brunthaver, entered into the following written agreement with the defendant.

“An article of an agreement between Olive L. Brunt*4haver, of Erie, Monroe county, Michigan, of the first part, and N. Shepardson, M. D., of Eremont, Ohio, of the second part, witnesseth:

That said party of the first part agrees to furnish to the said party of the second part the suin of three thousand dollars, to be used in the drug business at such place or places as they both may agree upon; and that said party of the second part…
