The plaintiff in error, Anthony De Suno, (hereinafter called the defendant,) was indicted in the criminal court of Cook county on March 20, 1932, together with Lawrence King and Jessie King, on a charge of burglary of the store of the Cutler Shoe Company, a corporation, in Chicago. The defendant was- tried alone before the court upon waiver of a jury, was convicted, and after the usual motions for a new trial and in arrest of judgment were overruled was sentenced to the penitentiary.
