The plaintiff brings this action to recover for damage to two carloads of watermelons, one of which was shipped by him to Boston from North Carolina and the other from South Carolina. The two initial carriers *288were southern railroads and the defendant, the last of several railroads named in the bills of lading, delivered the shipments at Boston to the consignee therein designated. The case was tried before a judge of the Municipal Court of the City of Boston.
