Before the Court is the United States Trustee’s (“Trustee”) appeal of the bankruptcy court’s order denying the Trustee’s motion to dismiss Roy G. Pedigo’s Chapter 7 bankruptcy petition. The sole issue on appeal is a strictly legal one: May the debtor’s bad faith in filing a Chapter 7 petition constitute cause for dismissal pursuant to 11 U.S.C. § 707(a)?
