Carro, J.

Defendant was indicted on a single charge of criminal possession of a weapon in the third degree, based upon the seizure of a loaded .38 caliber revolver from his person. At issue on appeal is the propriety of the police action which yielded the weapon.

Prior to trial, defendant moved to suppress the physical evidence recovered from him. At the suppression hearing, Police Officer Carl Zanchelli testified that at approximately 8:30 p.m. on March 1, 1986, he was sitting in uniform and unaccompanied in a marked patrol car on the northwest corner of Stanton and Ludlow…
