Judgment, Supreme Court, New York County (Jay Gold, J., at hearing; *367Carol Berkman, J., at plea and sentence), rendered November 13, 1996, convicting defendant, upon his plea of guilty, of criminal possession of a weapon in the third degree, and sentencing him to a term of 3 years, reversed, on the law, the gun recovered from defendant and his second statement to the police are suppressed, the plea vacated, and the matter remanded for further proceedings.
