Plaintiff Sea Spray Holdings, Ltd. (“Sea Spray”) commenced two proceedings in the New York State Supreme Court, New York County, against Pali Financial Group, Inc. (“Pali”) and Buyers United, Inc. (“Buyers”), seeking to recover obligations asserted pursuant to a promissory note. That court issued an order directing a stay of arbitration proceedings that Buyers had commenced in Salt Lake City, Utah before the American Arbitration Association (the “AAA”).
