PORTEOUS, District Judge.
Before this Court are cross Motions for Summary Judgment that came for hearing on a previous date. Oral arguments were heard on Thursday, November 19, 1998 and the matter was taken under submission. Having heard the arguments of counsel and having studied the legal mem-oranda submitted by the parties, this Court is fully advised on the premises of the case and sits ready to rule.
