Action in the district court for Olmsted county to compel defendant to support a bastard child. The case was tried before Snow, J., and a jury which rendered a verdict of guilty. From an order denying defendant’s motion for a new trial, defendant appealed.

In an action to compel the defendant to support a bastard child, the complaining witness testified to a material fact which strongly tended to show that the defendant was the father of the child. At the request of the defendant the court gave certain instructions to the effect that the particular issue upon which the complaining witness testified must be determined by the jurors from all the circumstances and evidence, and that they must determine' from the evidence whether or not 'the *266witness testified truthfully.
