Proceeding pursuant to CPLR article 78 (initiated in this Court pursuant to Public Health Law § 230-c [5]) to *707review a determination of respondent Administrative Review Board for Professional Medical Conduct which imposed a five-year period of probation upon petitioner.

Petitioner has held a medical license in New York since 1987. He established his practice in spinal surgery in Las Vegas, Nevada in 1993, and has not been registered as a New York physician since December 31, 1992.
