This is an appeal from an order of the district court dismissing appellants’ complaint with prejudice. Respondent Continental Telephone Company (“Continental”) and the Southern Nevada Culinary and Bartenders Pension Trust’s investment manager (“Pension Trust”) entered into two contracts. Pursuant to these contracts, Continental agreed to install underground telephone cables at a development in Gardnerville.
