THIS CAUSE comes before the Court upon defendant Zurich American Insur anee Company’s (“Zurich”) Motion to Dismiss the Amended Complaint [DE 9] filed on August 28, 2009. Plaintiff Sandalwood Estates Homeowner’s Association, Inc. (“Sandalwood”) filed a response [DE 20] on September 25, 2009. Zurich replied [DE 21] on October 5, 2009.
