OPINION

BUTTS, Justice.

This is an appeal from dismissal of appellant’s petition for writ of mandamus.

It is necessary to set out the previous history in this case. Charges arising from the same transaction which resulted in appellant’s conviction for capital murder in Bexar County had been filed in Medina County. The Medina County charges against appellant were dismissed after his conviction in the Bexar County.
