Appeal from a judgment of the superior court for Pierce county, Clifford, J., entered December 20, 1909, upon the verdict of a jury rendered in favor of the plaintiff, in an action for personal injuries sustained by the driver of a horse which was frightened by defendant’s automobile.

On March 20,1909, Frances It. Brown, one of the plaintiffs, and who will be hereafter referred to as “the plaintiff” in this case, had gotten into a buggy at a hitching post near Hall’s store, East Fern Hill, in Pierce county. She’ was on what is known as Pacific avenue. Just as she got into the buggy, she saw an automobile, which proved to belong to the defendant, coming at right angles on what is known as the Wilson road. Hall’s store faces Pacific avenue.
