These two cases were argued and heard together. In the first case the question presented is whether Naval Commander Hetherington, who was on the retired list, should have received the pay and allowances of his grade of commander during the period of his active duty service in time of war. The second suit is by his daughter, suing in her own right and as guardian of her brother, the two being the only surviving children of Commander Hetherington, and the question there is whether the children of a retired officer of the Navy, who. was at the time of his death, on September 16, 1917, serving on…
