Some time in March, 1917, one Cerón Belier began an action in the superior court of Pacific county against the relator, Edmond Poussier, to recover for personal services rendered in the case of his side wife. After the service of the summons upon him, 'the relator gave written notice of his appearance in the action, and on March 27, 1917, filed the same in the office of the clerk of the superior court, together with an affidavit of merits and a motion asking a change of venue to the county of King.
