In this SCPA 2103 discovery proceeding, the administratrix, decedent’s daughter, seeks to recover the sum of $280,000 plus interest from the respondents, decedent’s son, Howard, and his wife, Sheila. The parties agree that the funds which had been deposited into the accounts containing the names of decedent and Howard had initially belonged solely to the decedent and that Howard, prior to the decedent’s death on March 3, 1989, at the age of 90, had withdrawn $280,000 from the accounts and deposited the proceeds into accounts in the names of himself and…
