Darryl and David Brown and sixteen other public school children, the appellants, challenge the constitutionality of amendments that restricts federal methods for assuring nondiscrimination in public schools receiving federal support.1 The amendments essentially prevent the Department of Health, Education, and Welfare (HEW)2 from requiring “the transportation of any student to a school other than the school which is nearest the student’s home.” 3 The district court found that the existence of an…
