Following a bench trial, defendant, Michael W. Bussan, was convicted of burglary (720 ILCS 5/19 — 1(a) (West 1996)) and theft (720 ILCS 5/16 — 1(a)(1)(A) (West 1996)). The trial court imposed concurrent prison terms of 6 years for burglary and 364 days for theft. On appeal, defendant argues that his theft conviction violates the “one-act, one-crime” rule and must be vacated. Defendant also contends that he is entitled to 121 days’ credit for time served in presentence custody. We affirm defendant’s burglary conviction and sentence therefor and vacate his theft conviction and sentence…
